Terms of Service

These Terms explain your rights and responsibilities when using Duwiz.

1. Acceptance of Terms

  • • By creating an account, accessing, or using Duwiz, you agree to these Terms of Service. If you do not agree, you must not use the platform.
  • • These Terms apply to all users, including creators, brands, and visitors.

2. Platform Overview

  • • Duwiz is a marketplace that connects brands and creators for campaign collaborations, proposals, negotiation, and content tracking.
  • • Duwiz does not process payments or transfer funds between users. All financial transactions must be handled off-platform directly between the brand and the creator.
  • • We may update, improve, or discontinue features at any time to maintain platform quality, security, and compliance.

3. Eligibility and Accounts

  • • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and form binding agreements.
  • • You must provide truthful, current, and complete information during registration and onboarding.
  • • You are responsible for maintaining account security and all activity under your account.
  • • We may suspend or terminate accounts with false information, abuse, fraud, or policy violations.

4. Creator Obligations

  • • Creators must accurately represent audience metrics, handles, rates, and work samples.
  • • Creators must deliver selected campaign activities and submit valid proof where required.
  • • Undisclosed conflicts, fake engagement, or misleading results are prohibited.

5. Brand Obligations

  • • Brands must provide clear campaign scope, budgets, dates, and requirements.
  • • Brands are responsible for lawful campaign content and regulatory disclosures.
  • • Brands may not misuse creator data or request prohibited or unlawful activities.

6. Campaigns, Proposals, and Deliverables

  • • Campaign visibility, invitations, deliverables, activities, and budgets are governed by campaign configuration.
  • • Accepted proposals form a binding platform record of work scope between participants.
  • • Parties should use platform messaging/negotiation history for transparency and dispute context.

7. User Communication and Interactions

  • • Users are expected to communicate professionally via platform messaging. Harassment, abuse, or deceptive practices are strictly prohibited.
  • • Users may utilize platform tools to block others to prevent unwanted communication. Duwiz reserves the right to review messages reported for policy violations or abuse.

8. Payments, Invoicing, and Taxes

  • • Duwiz is not a party to any payment agreements. Brands and creators are solely responsible for agreeing upon, issuing, and collecting payments off-platform.
  • • Duwiz is not responsible or liable for unpaid invoices, refunds, chargebacks, or any financial disputes arising between users.
  • • Users are exclusively responsible for their own taxes, reporting, invoicing, and legal financial obligations in their respective jurisdictions.

9. Acceptable Use

  • • You may not use Duwiz for illegal, fraudulent, abusive, harassing, infringing, or deceptive activities.
  • • You may not scrape, reverse engineer, disrupt, or attempt unauthorized access to systems or user data.
  • • Automated actions must respect platform integrity, performance, and applicable law.

10. Intellectual Property

  • • Each user retains ownership of their original content, uploaded assets, and brand assets unless they separately agree otherwise via a proposal.
  • • By uploading or posting content on the platform, you grant Duwiz a limited license to host, parse, and display content as needed to operate services.

11. Compliance and Disclosures

  • • Users must comply with advertising, consumer protection, disclosure, and platform-specific rules (including sponsored content disclosures such as FTC guidelines).
  • • Users are solely responsible for legal compliance in their jurisdiction.

12. Termination

  • • You may stop using the service at any time.
  • • We may suspend or terminate access for violations, legal reasons, security concerns, or misuse.
  • • Termination does not remove any off-platform payment or delivery obligations accrued before termination.

13. Disclaimers and Liability Limits

  • • Services are provided "as is" and "as available" without warranties to the fullest extent permitted by law.
  • • Duwiz is not liable for user-generated content, unfulfilled proposals, missed payments, or indirect, incidental, consequential, special, or punitive damages arising from platform use.
  • • Our total liability is limited to the amount you paid to Duwiz (if any) in the 12 months before the claim.

14. Changes to Terms

  • • We may update these Terms to reflect legal, technical, or business changes.
  • • Material updates will be posted with an updated effective date.
  • • Continued use after updates means acceptance of the revised Terms.
